The investigation is confidential
The President of the chamber specialising in management errors appoints a reporting judge to investigate the case. The defendant is informed of the initiation of proceedings against them by registered letter with acknowledgment of receipt and may be assisted by a lawyer.
The reporting judge is authorised to:
- Conduct all inquiries and investigations with any public or private entity connected with the case;
- Request that any natural or legal person provide all documents needed for the investigation;
- Conduct any inquiries and investigative operations on site;
- Hear witnesses;
- Seek the opinion of the competent authorities under the signature of the Court’s First President;
- Request, through the Public Prosecutor’s Office, copies of documents relating to court cases from the ordinary courts, except for cases in progress.
Final investigation report
At the end of the investigation, the reporting judge prepares a final report, which is sent to the Public Prosecutor’s Office.
The Public Prosecutor’s Office has thirty (30) days to submit written, reasoned conclusions on the final investigation report.
- The President of the chamber competent for management errors informs the defendant, by registered letter with acknowledgment of receipt, that they may consult the case file, including the observations of the Public Prosecutor’s Office, within thirty (30) days.
- On written request to the competent chamber, the defendant may obtain copies of documents in the file.
- Within thirty (30) days of consulting the file or obtaining copies of the documents, the defendant submits a written defence and may request that witnesses of their choice be heard, either personally or through a lawyer.
